VI.61/2 CDE/WER (withdrawal function) in Book VI, Title 3, Chapter 2, Section 4. Art. 9 amends art. VI.45, § 1, 8° (pre-contractual information on the existence and location of the function). Art. 25 replaces instruction (3) of Annex I (model withdrawal information). Art. 28 amends art. XV.83, 8° (penalties).

It was published in Lovtidende A on 21 June 2025 and comes from bill L 185 (Folketingsåret 2024-25), adopted 96-0. - § 1, nr. 19 inserts a new § 20 a (fortrydelsesfunktion) into lov om forbrugeraftaler (forbrugeraftaleloven).
§ 356a BGB "Elektronische Widerrufsfunktion bei Fernabsatzverträgen". Art. 1 Nr. 8 of the Gesetz zur Änderung des Verbrauchervertrags- und des Versicherungsvertragsrechts sowie zur Änderung des Behandlungsvertragsrechts of 03.02.2026, BGBl. 2026 I Nr. 28 (published 05.02.2026), replaced the earlier § 356a with this provision. Art. 10 Abs. 1 puts it in force on 19.06.2026. Draft only: the Anteproyecto de Ley de contratos de crédito al consumo (MINECO, Presidencia and Derechos Sociales/Consumo), approved in first reading by the Consejo de Ministros on 7 Jan 2026, with public hearing until 30 Jan 2026. Its Disposición final tercera, apartado Cinco, would insert a new art. 106 bis ('Ejercicio del derecho de desistimiento en los contratos a distancia celebrados mediante una interfaz en línea') into the TRLGDCU (Real Decreto Legislativo 1/2007, BOE-A-2007-20555). Apartado Cuatro would amend art. 97.1.j). If adopted, the law enters into force 20 days after publication in the BOE (DF decimocuarta.1). As of 2026-09-29 the BOE consolidated TRLGDCU has not been amended (no art. 106 bis); the Congreso pages could not be read in the cross-check (HTTP 403), and the 2026-09-25 research found no Proyecto de Ley there.
